This page sets out the limits of our liability, and your indemnity to us, when you use kitchenwarehouse.shop or buy from Kitchen Warehouse Company, a division of Caruso Consulting Co Ltd. It forms part of our Terms & Conditions.
Your rights come first
Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, for fraud, and any right under the consumer protection law of your province or territory that cannot be given up. The law in some provinces may not allow some of the limits below, and where it does not, that limit does not apply to you.
Limits of our liability
Subject to the section above, and to the extent the law allows:
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill;
- we are not liable for loss caused by misuse of a product, by not following the manufacturer's instructions or care guidance, or by normal wear and tear;
- where we are liable, our total liability for any claim connected with an order is limited to the amount you paid for the products in that order.
Website availability
We work to keep the site available and accurate, but we do not guarantee uninterrupted or error-free access, and we may change or withdraw any part of it without notice.
Your indemnity
You agree to indemnify us against reasonable losses, costs and claims we incur because of your breach of our Terms & Conditions, your misuse of the site, or your infringement of another person's rights through your use of the site.
